Assam: CID files charge sheet against the then SP. and Addl. SP Darrang, OC, Dhula PS
Investigation revealed that SI Utpal Borah has accepted illegal gratification of Rs. 5 lakh in three instalments during June and July 2022 for himself and for the then SP and Addl. SP, Darrang.
GUWAHATI- CID of Assam Police filed a charge sheet against three police officials in connection with accepting bribe from the family of the accused of a rape and murder of a 13-year-old minor girl under the jurisdiction of Dhula Police Station in Assam’s Darrang district in June, 2022, Informed SP, CID Assam.
CID filed a charge sheet in CID PS. Case No. 20/2022 against SI Utpal Borah, the then OC, Dhula PS, Raj Mohan Ray, APS the then SP, Darrang , Rupam Phukan, APS, the then Addl. SP, Darrang and Mrs Niju Nath, W/o Krishna Kamal Baruah, informed the SP CID.

It may be recalled that CID during course of investigation of Dhula P.S. Case 114/2022 pertaining to the murder of a minor girl child has found that a sum of Rs. 5 lakh was accepted from the family of the accused by SI Utpal Borah for himself and other senior police officers of the district.
Accordingly, a separate case vide CID P.S. Case No. 20/2022 U/s 120(B) IPC, R/W Sec 7(b)/8(1)(ii) of P.C. Act and Sec 98(a) of Assam Police Act, 2007 was registered before the Special Court, Guwahati for offences of bribery and violation of provisions of Assam Police Act, 2007.
Investigation revealed that SI Utpal Borah has accepted illegal gratification of Rs. 5 lakh in three instalments during June and July 2022 for himself and for the then SP and Addl. SP, Darrang.
During investigation the bank account details from where the money was withdrawn, persons who withdrew the money and paid to SI Utpal Borah were gathered. The Call Detail Records, Call Link Analysis and Geo Tower Analysis of all the mobile numbers along with the mapping of the travel history was conducted and it was proved that the bribe amount was paid in three instalments as a reward for extending undue favours to the accused Krishna Kamal Baruah, who is the main accused of the original Dhula P.S murder case. Mrs Niju Nath W/o Krishna Kamal Baruah had mobilized the said bribe amount of Rs. 5 lakh and paid the same through her relatives to SI Utpal Borah.

Further, the telephonic conversation between Raj Mohan Ray, APS, the then SP., Darrang and SI Utpal Borah, the then OC, Dhula PS. was also retrieved from the mobile phone of the accused and the recorded conversations were compared with the specimen voice samples of the accused.
The FSL voice spectrography report has certified that the tele-conversation in the mobile phone has matched with the specimen voice samples of SI Utpal Borah and Raj Mohan Ray, APS.
From the conversation, it was clear that Raj Mohan Ray was giving instructions to SI Utpal Borah to extend favours to the accused.
Investigation revealed that all three police officers have willfully violated the provisions of Assam Police Act, 2007 and extended undue favours to the accused and tried to screen and protect the accused Krishna Kamal Baruah who is involved in the murder and attempt to rape of the minor girl child and obtained bribe money as a reward.
Investigation also revealed that SI Utpal Borah has re-formatted his mobile phone in order to erase some of the evidences as certified by the FSL expert and hence caused disappearance of evidence.

After completion of investigation, prosecution sanctions U/s 197 Cr.P.C., U/s 19(1) of P.C. Act, 1988 (as amended in the year 2018) and U/s 102 of Assam Police Act, 2007 have been obtained from the competent authorities to prosecute the three police officers.
Accordingly, a charge sheet U/s 120(B), 201 IPC, Section 7(b), 8(1)(ii) of P.C. Act, 1988 (as amended in the year 2018) and Section 98(a) of Assam Police Act, 2007, for offences of criminal conspiracy, destruction of evidence, public servant accepting bribe and for bribing a public servant was filed against SI Utpal Borah, Raj Mohan Ray, APS, Rupam Phukan, APS and Mrs Niju Nath, along with 36 documents, 24 material objects and by listing 61 witnesses before the Special Court, Guwahati.
