Assam: HC admits PIL against hill districts bandh, issued notices

Gauhati High Court admitted a PIL filed by General Secretary, Asomiya Yuva Manch against the Hill district bandh .

Division bench of  Gauhati high court comprising Chief Justice Ajit Singh and Justice Manojit BHUYAN in a PIL No 56/18 seeking compensation amounting to Rs 15 Cr and penal actions for the loss and damages caused because of clamping of 24 hours Hills Districts (Karbi Anglong, Dima Hasao and West Karbi Anglong ) Bandh from 5 am of 04.09.2018 to 5 am 05.09.2018 issued notices  to the State Govt , SPs & DCs of  all three district , Karbi Anglong and NC hills autonomous council , presidents of all three organisations namely Miss Merina Beypi, Suren Hanse And Holiram Terang and the directed matter to be listed after 5(five) weeks.

The Petition is filed by Jitul Deka , General Secretary, Asomiya Yuva Manch.

In the petition, petitioner stated that bandhs are illegal and no one in this country has the right to call a bandh as it violates the pronouncements of Honourable Supreme Court and Gauhati High Court.

The bandh was called by Karbi Students Association(KSA), Karbi Nimso Chingthur Asong (KNCA), and Autonomous State Demand Committee (ASDC) .

Talking to Northeastindia24 , Advocate Amit Goyal informed that “In the petition, the petitioner is also seeking direction against the Presidents of three organisation to deposit Rs. 5(five) Crore each with the State Government for the Bandh Loss Compensation  and this amount be utilized for providing facilities, benefits and additional services to the people of Karbi Anglong , Dima Hasao  etc.”.

In the Petition, the petitioner is also seeking direction for taking  all actions, including arrest, detention and prosecution against those who seek to enforce such ‘bandh’ or ‘hartals’ by organising, leading or participating in rail and rasta rokos and assaults on trains, buses, other vehicles and private citizens.

Bandh Passed Peaceful

On the other hand the bandh was passed peaceful. The  bandh has been called to demand Central Government for the creation of a separate autonomous hill State. The leaders of the organizations stated that the people of Karbi Anglong, Dima Hasao and West Karbi Anglong had all along been aspiring for a State of its own. This is a more than five-decade-old demand of the hill people. But, government has been ignoring their demands.
